October 2011:
HSBA
Names New Executive Director:
On October 27, The Hawaii State Bar
Association named Patricia Mau Shimizu, current Chief Clerk of the Hawaii State
House of Representatives, to be its new Executive Director. The appointment is
effective on December 1st.
Mau Shimizu succeeds Lyn Flanigan,
who announced her plans to retire from the association in January 2011 following
an 8-year tenure as Executive Director.

On May 3, 2011 the Senate confirmed the

State Senate Confirms David Louie as
Attorney General
February 8, 2011: HSBA Requests for Comment:
Bar
members were e-mailed a notification regarding the nomination of David
M. Louie to the position of Attorney General for the State of Hawaii.
Deadline for comment is set for February 16. See original email

Bar
members were e-mailed a notification regarding the nomination of Judge
Sabrina McKenna to the position of Associate Justice of the Hawaii
Supreme Court. Deadline for comment is set for February 3. See original email dated January 25.
January 15, 2010: HSBA Board amends policy/procedures for participation in judicial selection process.
After
receiving member comments submitted in response to the President’s
request in late 2010, the Board formed a committee to review and propose
revisions to the Board’s long-standing policy on Judicial and Executive
Appointments. After extensive review, at its December meeting, the HSBA
Board approved changes in its written policy which:
* Amend the disclosure provisions
to provide that the HSBA President/designee may present to the
confirming authority a statement prepared by the Board on the reason for
the rating of the nominee but may only answer questions relating to
HSBA policies and procedures
* Amend the conflict of interest
provisions to exclude from voting on a nominee any director who has or
intends to take a public position on a nominee
* Amend the criteria to add a
provision on “Responsibilities and Duties,” which specifically refers to
qualifications for the position in question
Revised Section 1.8 of the Board Policy entitled BOARD PARTICIPATION IN JUDICIAL AND EXECUTIVE APPOINTMENTS.

Access to
Justice

Judges, court administrators, and
bar leaders from all islands met on November 18 at a “Self-Help Centers
Summit” to discuss establishment of self-help centers in the courts to
enable access to justice. The summit was organized by the HSB Delivery
of Legal Services to the Public Committee, chaired by Shannon Wack and
Jo Kim. Pictured are delegations from Kauai (above), Maui & Oahu

Senior Counsel Division

On November 18, SCD members
enjoyed the last event of the year with a lunch presentation featuring
Professor James Pietsch (far right) of the UH Elder Law program. The
presentation "Planning for the Future: Taking Charge of Your Health and
Your Wealth in Times of Uncertainty” was held at the Pacific Club and
featured a helpful Q & A for the attendees.

2011 RENEWAL:
Due to up-to-the-last-minute
budget/planning decisions, the RENEWAL MATERIALS will be mailed in early
December. Materials are mailed to the ‘address on record’ of each
member and all members are strongly encouraged to renew by the online
renewal process for prompt and efficient renewal. Deadline for renewal
will be January 31, 2011, both for completion of online renewal (BE SURE
YOU RECEIVE AN EMAIL CONFIRMATION) and for mailing of paper renewal
forms.

REPLACEMENT
OF
HSBA MCLE CERTIFICATES
:
Although
all members have been reminded to retain MCLE certificates, we are
receiving a
large number of requests for replacement certificates from HSBA produced
seminars. As we struggle to
meet these unanticipated requests, PLEASE BE ADVISED that you do not
have to
produce your MCPE
certificate
unless you are audited
.
Random
audits will be conducted after renewal is complete in February
2011. A $15 fee will be charged for each
certificate. To order a replacement, please see our online form.
Please allow at least 2 weeks
for our staff to
verify your attendance at the HSBA seminar and process your replacement
certificate.

HSBA
officers
meet with the delegation of lawyers from the Hainan Lawyers Association
who
attended the Fourth Seminar on the Principles of Chinese and American
Law. In an
exchange of gifts, HSBA presented the Hainan delegation with the Hawaii
Real
Estate Law Manual Volumes 1 and 2 and received a set of books about the
laws in
the province of Hainan.

Friendship
Agreement between the HSBA and the Tokyo Dai-Ichi Bar Association
Renewed!

2005 agreement has been renewed which pledges to develop and present
mutually beneficial programs and activities in both Hawaii and Japan.

HSBA Issues Press Release
& Resources to Clarify its Role on Judicial and Executive
Appointments
In light of the number of judicial vacancies at various levels in
the state, HSBA has taken the initiative to inform the public and its
members on the Bar's purpose and procedures for the assessment of
judicial nominees. First, review the HSBA's board procedure on its participation
in the judicial and executive appointments that comes from the
board policy manual. Further information can be found in the August 2,
2010 press
release or President Hugh Jones informative message to the bar earlier
this year or the March 2009 lead article by Steven Chow
for the
Hawaii Bar Journal.

Candidates and familiarize yourself with their goals for the Bar.
Ballots will be distributed electronically in mid-August. A formal
announcement of the 2011 Board will be made at the HSBA Annual Meeting
on September 17 at the Annual Bar Convention at
the Hilton Hawaiian Village, Coral Ballroom.
